Court documents: 3 killed in downtown Sac shooting were part of gang-related dispute ahead of gunfight
New details reveal three of the six people killed in the gang-related shooting in downtown Sacramento earlier this month were involved in a dispute ahead of the gunfight, according to newly filed court documents.
The three men who were killed – Joshua Hoye-Lucchesi, 32; DeVazia Turner, 29; and Sergio Harris, 38 – were associated with local gangs, according to documents filed Friday by Sacramento County District Attorney Anne Marie Schubert. Investigators know Turner fired a weapon, but it's unclear if all three men fired weapons during the shooting.
Officers previously said there were at least five gunmen involved in the shooting that also injured a dozen other people. Two of the suspects were among those injured – brothers Smiley and Dandrae Martin. Both were arrested in connection to the shooting and have a criminal history. Smiley is in the hospital but will be booked into the Sacramento County Main Jail upon release. Authorities plan to charge him with being a felon in possession of a handgun and carrying a machine gun that night.

Daviyonne Dawson, 31, was the third person arrested after the shooting, but he is not facing any charges directly related to the shooting. Dawson was seen carrying a gun “in the immediate aftermath” of the shooting downtown, according to police.
Police are now looking for another suspect, 27-year-old Mtula Payton. He is wanted on multiple felony warrants that include domestic violence and gun charges.
In three minutes, at least five people fired guns in shootout
Sacramento police have said the shooting was a result of a dispute between at least two groups of men who were involved with local street gangs.
The court documents reveal that Hoye-Lucchesi and Smiley are a part of the Garden Blocc Crips.
Payton and Turner are a part of a rival gang called the G-Mobb. Harris was a part of a gang allied with G-Mobb called Del Paso Heights Bloods.
The incident started at 1:57 a.m. on April 3, documents said.

Surveillance video from the area shows 70 to 80 people gathered near 10th and K streets. Court documents said a person was standing with Smiley near Sharif Jewelers. Video showed the person next to Smiley point in the direction of where Payton and Turner were.
Five seconds later, Payton is seen turning and reaching in his waistband. Then Payton and Turner start approaching the corner where the Martin brothers and Hoye-Lucchesi are standing. By 1:58 a.m. Payton and Turner were joined by Harris, according to court documents.
One of the female victims, 21-year-old Johntaya Alexander, was then caught in the middle of the dispute when her car pulls up. Family told KCRA 3 that she was picking up her older sister from a club. They believe she exited her car to either check on her sister or buy the sister a hotdog when shots were fired.
By 2 a.m. Smiley is holding a handgun with an extended magazine. Seventeen seconds later, Turner and Smiley are seen exchanging gunfire, according to court documents. Turner, Harris, Hoye-Lucchesi and Yamile Martinez-Andrade, who was walking there, were all hit by gunfire.
In video from the scene, at least 76 shots can be heard within 54 seconds and people can be seen running from a fight. It's unclear if the fight seen in the video is related to the shooting.
Smiley is seen on surveillance video firing multiple rounds from his firearm, the documents said. A preliminary ballistics analysis showed it was around 28 rounds. More than 100 shell casings littered the street.
He is then seen tossing the handgun away, right before officers stop him. Investigators found the gun said to be a Glock 19 handgun with an extended 30-round magazine, a tactical laser sight and a full-automatic selector switch.

It's still unclear what caused the dispute which led to the gunfight.
Smiley 'boasted about shooting rival gang members' in social media video hours before
In a social media clip posted hours before the shooting, the Martin brothers are seen posing with Hoye-Lucchesi and two handguns and a rifle. In the video, Hoye-Lucchesi and Smiley talk about going downtown while armed to loiter outside nightclubs and “boast about shooting rival gang members,” according to the 13-page document.
In the video, both Hoye-Lucchesi and Smiley Martin state allegiance to the Garden Blocc Crips.

The coroner’s office in Sacramento County identified the three men and three women who were killed as:

- Melinda Davis, 57
- Sergio Harris, 38
- Joshua Hoye-Lucchesi, 32
- Yamile Martinez-Andrade, 21
- DeVazia Turner, 29
