1. TERM OF LICENSE. Dormitory space will be licensed for a period commencing on the clinical rotation start and end dates. Check in must occur between 3:00 p.m. to 11:00 p.m. on the day before the commencement date. Check out must occur by 12:00 p.m. the day after the end date.
2. OCCUPANCY AND USE. The Student alone must occupy their assigned space during the License Term. Any vacant space in the room may be filled by Hospital without prior notice to Student. Student shall not interfere with any new occupant’s use of the space or room. Student may not transfer or assign any rights Student may have under this License to any other person and any attempts to do so are null and void. Student shall use the assigned space only for its intended purpose and shall not permit any other person to use the room for any purpose without Hospital’s consent.
3. REGULATIONS AND POLICIES. Student agrees as a condition of this License that Student will abide by all of the policies set forth in the digital downloads available to student. This includes, but is not limited to, unauthorized possession, alteration, defacement of any key/ID card and the illegal entry of any room by any means. Firearms, alcohol, smoking, illegal drugs, hazardous materials and the burning of candles or incense is strictly prohibited and will result in immediate termination of the License and immediate vacancy of the licensed space in addition to police action, if warranted.
4. LICENSE PAYMENT.
Student shall pre-pay the room license fee pursuant to the instructions in the application process.
5. CANCELLATION. This License binds Student for the entire License Term unless Hospital receives a written cancellation request and approves cancellation of the License. If Hospital approves of the cancellation, it will provide a pro-rata refund for any days remaining under the License Term.
6. LICENSE TERMINATION. Hospital reserves the right at any time, in its sole discretion, to terminate this License, to postpone or cancel the assignment of any space, or to postpone the commencement of the License Terms if (a) Student failed to pay any sum due under this License when due, violates any other term of this License, ceases to be a currently enrolled registered student in good-standing, and/or fails to occupy or improperly occupies the Assigned Space; (b) if Hospital violates any term of the License or the policies and regulations applicable to the Assigned Space; and/or (c) for any other reason Hospital, in its sole discretion, deems to be good cause. Upon termination of this License or suspension from the Premises, Student is required to immediately vacate the Assigned Space. In the event the License is terminated or Student is suspended from the Assigned Space, Hospital may take any and all action (including, litigation) to remove Student from the Assigned Space. If this License is terminated because of Student’s failure to fully perform any of Student’s obligations under the License, Student will continue to be responsible for all fees due under or as a consequence of this License for the entire original License Term.
7. ACCESS. Hospital reserves the right, at any time and for any reason, in its sole discretion, to enter the room/Assigned Space without prior notice to make repairs, to inspect for compliance with health, fire, or building codes, or with applicable policies or regulations, or because of any situation that Hospital, in its sole discretion, deems to be a danger to health, safety, or property.
8. PERSONAL PROPERTY. Hospital shall not be liable or otherwise responsible in any way for any loss of or damage to Student’s personal property. Hospital may dispose of any personal property left in Hospital’s space after Student vacates the Premises.
9. CONDITION OF PREMISES. Student shall maintain the room in a clean, safe, and undamaged condition at all times. Student will not permit noise or odors to emanate from the assigned space in such a way as to unreasonably disturb other residents, including those sharing the room. Student shall not store food so as to cause the infestation of the assigned space. Student and any other persons assigned to the room shall be jointly responsibly for cleaning and maintaining common areas. Student shall not alter the room or any furnishings therein in any way without Hospital’s written consent. When Student vacates the assigned space, Student shall remove all of Student’s personal property and leave the room and any furnishing clean and in the same condition they were when student commenced occupancy, ordinary wear and tear excepted. Student agrees that Hospital may promptly dispose of any personal property left in the room after the end of the License Term. Hospital will assess cleaning, repair, and disposal charges equally among all those assigned to a room, unless individual responsibility is established before departure. Charges for damage to any public areas or furnishings in a housing facility may be assessed, in Hospital’s sole discretion, against any or all of the assigned to the floor or the entire facility.
10. VACATING THE SPACE. Student shall vacate Student’s assigned space, and officially check out and return all access cards/keys by the end of the License Term (and immediately upon cancellation or termination of this License). If Student does not officially check out and/or return Student’s access cards/keys, and/or vacate the space by that date, Hospital reserves the right to change the locks for the room and terminate the access card.
11. MISCELLANEOUS. This License is the sole agreement between Student and Hospital regarding the Assigned Space and may not be changed except in writing signed by Hospital and Student. If any provision of this License shall be found to be invalid, the remaining provision hereof shall continue in full force and effect. In the event of a court determination of any Hospital liability to Student in connection with this License, the aggregate amount of the damages to be paid by Hospital shall not exceed the sum Student paid under this License. This License shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania applicable to contracts made and to be performed therein. Student agrees to submit to the jurisdiction of the federal and state courts in Lehigh County, Pennsylvania, for the resolution of any disputes arising hereunder.
