Overview

The Deputy City Attorney is an essential member to the City Attorney's Office. The successful candidate will review, prepare and litigate both criminal and civil cases for the City of Missoula.


Details: Priority screening will begin on July 26, 2022. Applications will continue to be accepted until an adequate applicant pool has been established. 

Essential Functions

  • Prosecute misdemeanor criminal violations, DUIs, general and sexual assaults, etc.; prepare for pretrial court proceedings; provide discovery pursuant to Montana state law for criminal misdemeanors.
  • Develop appropriate plea agreements, litigate cases in jury trials and represent the City during jury and bench trials in Municipal Court.
  • Interview witnesses and victims; prepare witnesses for trial; follow rules of evidence.
  • Monitor suspended sentences, and petition court to revoke suspended sentences, when warranted; attend district court civil implied consent refusal hearings; assist civil attorneys as required.
  • Research and write legal memoranda, motions, and briefs; provide legal advice and prepare legal pleadings, and other court document.
  • Perform other duties as assigned.

Knowledge, Skills and Abilities

  • Knowledge of and ability to interpret and apply Federal, State, and Local laws, regulations, and guidelines relating to municipal operations, including Montana Code Annotated, Missoula Municipal Code, Administrative Rules of Montana, and uniform technical codes adopted by the City.
  • Knowledge of criminal and civil legal practices and procedures, including rules of evidence, conducting legal research, preparing court documents, pleadings, motions, and municipal ordinances. 
  • Skill in preparing cases for trial, litigating cases, and negotiating plea agreements.
  • Skill in operating office equipment, using various computer software and databases, including Microsoft 365, and the ability to learn job-specific applications and equipment.
  • Skill in negotiating and communicating, in person and writing, with the proven ability to establish and maintain effective working relationship with diverse individuals.
  • Ability to problem-solve and resolve conflicts with facilitating outcomes while maintaining a calm demeanor.
  • Ability to learn City and departmental policies, procedures, and practices.

Qualifications and Additional Application Materials

  • Juris Doctorate degree from an accredited law school. 
  • Membership in the Montana State Bar and license to practice law in state courts, required upon hire.   
  • Must pass a fingerprint criminal history background check.
