Lack of Definition in Florida Robocall Bill Could Cause Problems for FIs, NAFCU Suggests

Robocalls

TALLAHASSEE, Fla.—Florida Gov. Ron DeSantis is expected to sign Florida's robocall bill into law after being presented the bill this week.

Of note, the bill adds a private right of action to the state's existing anti-robocall law and requires callers to collect a customer's express written consent before placing any marketing calls to consumers via an automated dialing system.

In addition, unlike the Telephone Consumer Protection Act (TCPA), the bill does not define "automated system." NAFCU noted that it is concerned this uncertainty surrounding "automated system" may put financial institutions in the state at even greater risk of litigation.

DeSantis now has 15 days to veto the bill before it becomes effective July 13. However, the bill's text calls for a July 1 effective date. If DeSantis signs the bill before the designated 15 days are up, the date he signs the bill into law will play a large factor in the effective date, NAFCU noted.
