Governor Polis Signs First Bill of the 2022 Legislative Session to Provide Real Relief for Small Businesses 

DENVER - Today, Governor Polis signed the first bill of the legislative session into law. The bipartisan HB22-1027 Sales Tax Destination Sourcing Rules Exception provides relief and reduces paperwork for small businesses by extending the deadline for Colorado small businesses to comply with the Sales and Use Tax system for purposes of destination sourcing from February 1, 2022 to October 1, 2022.

“Our administration is focused on providing real relief, reducing regulations and cutting red tape for small businesses which are an economic engine for so many communities across our state,” said Governor Polis. “I am proud to support our small businesses that create good jobs, strengthen our communities and economy. I thank the sponsors for their important work to bring this legislation to my desk and to the legislature for moving this bill quickly.”

The bill, sponsored by Representative Kevin Van Winkle, Representative Cathy Kipp, Senator Jeff Bridges, and Senator Rob Woodward garnered broad bipartisan support and passed both the Senate and House unanimously. The bill was signed administratively.

Sales & Use Tax System (SUTS) Update Report on Home Rule Municipalities

The City of Edgewater will go live on the Sales and Use Tax System on January 1, 2022.

The Town of Larkspur will be transitioning to a home rule, state-administered jurisdiction on January 1, 2022. After January 1st, you can call the taxpayer helpline at (303) 238-7378 for assistance with Larkspur sales tax for filing periods January 2022 onward.

Please continue to contact the Town of Larkspur for the remainder of December, and for any 2021 or prior sales tax questions. Sales tax forms and filing information can be found on the Town of Larkspur website.

The City of Aurora, City of Boulder, and City of Wheat Ridge have joined SUTS as a participating home rule, self-collecting jurisdictions. This brings the total number of participating, home rule, self-collecting jurisdictions to 56. Destination Sourcing Deadline Extended

Governor Polis signed SB21-282 on June 30, 2021, which extends the small business exception to destination sourcing requirements. This exception applies only to businesses with less than $100,000 in retail sales. Beginning February 1, 2022, all retailers will be required to apply the destination sourcing rules.

Destination Sourcing Deadline Extended

The General Assembly has adopted SB21-282, which extends the small business exception to destination sourcing requirements. This exception applies only to businesses with less than $100,000 in retail sales. Beginning February 1, 2022, all retailers will be required to apply the destination sourcing rules.

Notice to Retailers

Geographic Information System is Online and Available

Colorado retailers are advised pursuant to sections 39-26-104(3)(c)(III)(B) and 39-26-105.2(2), C.R.S., that the Geographic Information System (GIS) described in those sections is now online and available for retailers to use in determining the jurisdictions to which tax is owed and to calculate appropriate sales and use tax rates for individual addresses. The GIS is part of the new Sales and Use Tax System (SUTS).  

Retailers must take the following actions by July 1, 2021:

  • Retailers that were sourcing all sales to their business location pursuant to section 39-26-104(3)(c), C.R.S., must begin applying the “destination sourcing” rules set forth in section 39-26-104(3)(a) and (b), C.R.S.
  • Retailers that were utilizing address databases certified by the Department of Revenue pursuant to section 39-26-105.3, C.R.S., must ensure that the database provider is using the most recent information provided by SUTS in order to be held harmless under the terms of section 39-26-105.2(3), C.R.S.

Retailers currently using origin sourcing will find resources for transitioning to destination sourcing on our website, including:

Beginning July 1, 2021, all retailers will be required to apply the destination sourcing rules.  The Department does not have the authority to grant exceptions to these rules.

All retailers are encouraged to file sales tax returns for the state, state-administered local jurisdictions, and participating home-rule cities using SUTS. SUTS is a one-stop portal that will allow taxpayers to do all manner of tasks related to collecting and remitting sales and use tax in an easy, automated, and seamless fashion. The system has the following capabilities:

  • Accurate address location capability
  • A uniform remittance form
  • A single point of remittance
  • A taxability and exemption matrix
  • The ability to calculate tax rates on items with differing tax rates in the same jurisdiction
  • A record of the history of any changes.

To start off the new year, SUTS will welcome the City of Commerce City as a participating home rule, self-collecting jurisdiction for the month of January. Additionally, Cañon City became a home rule, state-administered jurisdiction on January 1st. This means the Department is now administering their sales tax collection, but their home rule status has not changed. For more Cañon City sales tax information, visit the City of Cañon City website. This change now brings the total number of home rule, self-collecting jurisdictions to 70.

Yesterday the City of Denver signed up to be a SUTS participating jurisdiction. The City of Parker also recently signed up as a participating jurisdiction. Each city needs to be onboarded on to SUTS before they can accept returns via SUTS. We currently have 526 businesses signed up to use the Sales & Use Tax System, with 81 businesses signing up in the last 24 hours. Retail Sales Tax Returns are due on or before the 20th of each month for monthly filers

Starting the month of November the City of Greenwood Village and the City of Lamar signed up to be a SUTS participating jurisdiction. Each city needs to be onboarded on to SUTS before they can accept returns via SUTS. We currently have 262 businesses participating in the final phase of testing, with 1 filing a return so far this month. Retail Sales Tax Returns are due on or before the 20th of each month for monthly filers

The Town of Glendale has signed up to participate in SUTS, bringing the number of home-rule municipalities that have signed the SUTS agreement to 22 or 31.4% of the total number of home-rule tax jurisdictions that self-collect.

SUTS System Update Report on Home Rule Municipalities

The City of Brighton and the City of Gunnison are now SUTS participating jurisdictions. Please reach out to each jurisdiction for more information on their sales/use tax rules and regulations. The Town of Windsor signed up for SUTS last week moving the number to 21 Home Rule Municipalities in the system. Approximately 37% of the 71 self-collecting municipalities are still reviewing or planning to review the SUTS System.

SUTS System Update Report on Home Rule Municipalities

Last week we had two cities switched from the Unknown category to actively pursuing an agreement with SUTS. We currently have 44% of the 71 Home Rule municipalities either on the SUTS System or have started the process of executing the agreement.

Below is a snapshot summary of the spreadsheet which is attached for your full review:

SUTS Project Final Report is Now Available

The SUTS System allows businesses to go to a single web portal (website) to find all sales and use taxes associated with a specific destination, as well as credits and deductions, and file a single remittance that will then go to multiple jurisdictions.

SUTS was exceptionally successful in every way:

  1. SUTS development was completed on May 6, 2020, seven weeks ahead of what was already an aggressive estimate of June 30, 2020.
  2. The budget was $18,750,000 over fiscal years 2020 and 2021, but SUTS was completed at almost $6 million under budget for FY20 and $4.6 million under budget for FY21. About $10.6 million in savings (56.30% of the appropriation) was given back to the General Fund at a critical time given the overall budget shortfalls due to COVID-19.
  3. Functionality exceeded the minimal viable product established at the start, allowing lookups of sales and use tax but also credits and exemptions with a robust remittance service.
  4. Acceptance rate also exceeded expectations. The original requirement was for three of the 71 self-collecting-tax municipalities to voluntarily use the system upon launching online and to reach 100% engagement within three years. As of July 6, 2020, twelve (17%) have already signed on, 24% more are in the process of approval, and 48% more are in the evaluation stage.
  5. Maintenance and support is far less than originally anticipated and less than maintaining a system in-house. Starting in FY22, support is estimated to be only about $2.2 million, which includes vendors, hosting, call center and infrastructure support for all jurisdictions across Colorado.

The significant success of SUTS illustrates the collaboration achieved between state government, local jurisdictions, vendors, and the business community. SUTS is a first-of-its-kind software program for the state of Colorado, developed using an Agile methodology. Stakeholders have been engaged throughout the process, from designing the functionality, through procurement, development and ongoing improvements.

This report outlines the background that started the SUTS legislation, then covers the controlled launch, budget, methodology, change management and the future of the system, as well as the stakeholder engagement and Governance that ensured its success. Stakeholder feedback is also included.

There are seventy Home Rule Municipalities that self-collect sales and use tax. New home-rule locally administered taxation jurisdictions have begun to sign up to participate in the SUTS Remittance Portal. Avon and Ca√±on City have been on boarded.
